SMS Terms and Conditions

1. Overview and Consent

By providing your mobile phone number and opting in to receive SMS text messages from Emerald Lantern LLC, doing business as HerbanVault ("HerbanVault," "we," "us," or "our"), you expressly consent to receive automated marketing and transactional text messages from or on behalf of HerbanVault at the mobile phone number you provided.

IMPORTANT: By opting in to receive SMS messages, you acknowledge and agree to these SMS Terms and Conditions. If you do not agree with these terms, you must not opt in to receive SMS messages or you must opt out immediately by texting STOP to any message you receive.

This SMS program is governed by these SMS Terms and Conditions, our Terms of Service, and our Privacy Policy. By participating in this program, you agree to be bound by all applicable terms and policies.

2. Program Description

HerbanVault's SMS text messaging program allows you to receive updates, notifications, and promotional offers via text message (SMS/MMS) on your mobile device.

Types of Messages:

You may receive the following types of messages:

Transactional Messages:

  • Order confirmations and receipts
  • Shipping notifications and delivery updates
  • Order status updates (processing, shipped, delivered)
  • Account notifications (password resets, security alerts)
  • Customer service responses

Promotional Messages:

  • Sales announcements and promotional offers
  • New product launches and restocks
  • Exclusive deals and limited-time discounts
  • Birthday or anniversary messages (if you've provided this information)

You may receive a combination of transactional, promotional, and marketing messages depending on your preferences and activity. You can opt out of promotional and marketing messages while continuing to receive transactional messages by following the instructions in Section 6.

3. Message Frequency

Message frequency varies and depends on your activity, preferences, and current promotions.

Typical Message Frequency:

  • Promotional messages: May vary from a few messages per week to several messages per month during high-volume promotional periods
  • Marketing messages: Typically 2-8 messages per month, but may increase during sales events or holidays
Note: Message frequency is NOT guaranteed and may change at any time without notice. You may receive more or fewer messages depending on:
  • Promotional campaigns and sales events
  • Your order activity and account interactions
  • Seasonal trends and holidays (e.g., 4/20, Black Friday, holiday season)
  • Product launches or restocks
  • Your loyalty program status and engagement

4. Message and Data Rates

Standard message and data rates from your mobile carrier may apply to all SMS messages sent and received as part of this program. HerbanVault does not charge any fees for SMS messages, but your mobile carrier may charge you for text messaging and data usage according to your carrier plan.

Important Notes About Charges:

Carrier Fees:

  • You are responsible for all charges imposed by your mobile carrier for receiving and sending text messages
  • Message rates vary by carrier and plan (check with your carrier for details)
  • Data charges may apply for MMS (picture/video) messages

International Charges:

  • Additional fees or restrictions may apply if you are traveling internationally or using an international mobile number
  • International messaging may not be supported for all carriers or countries
HerbanVault is NOT responsible for:
  • Charges from your mobile carrier for text messages or data usage
  • Any fees, surcharges, or roaming charges imposed by your carrier
  • Carrier restrictions, limitations, or service interruptions

Please contact your mobile carrier for information about your plan's text messaging and data rates. If you have questions about charges related to SMS messages, please contact your carrier directly.

5. Opt-In Consent

Consent to receive SMS messages from HerbanVault is NOT a condition of purchase. You can make purchases from HerbanVault without opting in to receive SMS messages.

How to Opt In:

You can opt in to receive SMS messages in the following ways:

  • Check the SMS opt-in box during account registration or checkout
  • Text a designated keyword (e.g., JOIN, START) to our SMS short code or phone number (as displayed on our website)
  • Complete an SMS opt-in form on our website or in promotional materials
  • Verbally consent during customer service interactions (where permitted)

Opt-In Confirmation:

After you opt in, you will receive a confirmation message to verify your consent. This message may include:

  • Confirmation that you have been subscribed to SMS messages
  • Information about message frequency and rates
  • Instructions for how to opt out (STOP) or get help (HELP)
  • A link to these SMS Terms and Conditions

By opting in, you certify that:

6. Opt-Out Instructions (STOP)

You can opt out of receiving SMS messages from HerbanVault at any time by following the instructions below.

How to Opt Out:

To stop receiving SMS messages:

  • Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any SMS message you receive from HerbanVault
  • Update your SMS preferences in your account settings on our website
  • Contact our customer support team at support@herbanvault.com and request to be removed from SMS communications

After you opt out, you will receive one final confirmation message confirming that you have been unsubscribed from SMS messages.

Effect of Opting Out:

Once you opt out:

  • You will no longer receive promotional or marketing SMS messages from HerbanVault
  • You may still receive transactional messages related to active orders or account activity (e.g., order confirmations, shipping notifications)
  • You can opt back in at any time by following the opt-in instructions in Section 5

Transactional Messages:

Please note that certain transactional messages (such as order confirmations and shipping notifications) are necessary for order fulfillment and account management. You may continue to receive these messages even if you opt out of promotional messages. If you do not wish to receive any SMS messages (including transactional messages), please contact our customer support team.

After you send HELP, you will receive a reply with information about the SMS program, including:

  • How to opt out (STOP)
  • How to get support
  • Contact information for customer service

8. Age Requirement

You must be at least 18 years of age (or 21 years of age in jurisdictions where that is the minimum legal age for tobacco-related products) to opt in to receive SMS messages from HerbanVault.

By opting in, you represent and warrant that:

  • You are of legal age to receive SMS messages from HerbanVault
  • You are the owner or authorized user of the mobile phone number you provided
  • You have the authority to consent to receive SMS messages on the mobile phone number you provided

If we discover that you are under the minimum legal age, we will immediately remove your phone number from our SMS program and terminate your participation.

9. Supported Carriers

Our SMS program is supported by most major U.S. mobile carriers. However, SMS delivery is subject to carrier availability and restrictions.

  • AT&T
  • Verizon Wireless
  • T-Mobile
  • Sprint
  • Boost Mobile
  • Cricket Wireless
  • MetroPCS
  • U.S. Cellular
  • Virgin Mobile
  • And other major and regional carriers

Carrier Limitations:

Please note that:
  • Not all carriers are supported, and some carriers may block or restrict SMS delivery
  • Carrier restrictions and policies may change without notice
  • HerbanVault is not responsible for carrier limitations, delays, or failures to deliver SMS messages
  • Certain carriers may charge additional fees for SMS messages (check with your carrier for details)

If you are having trouble receiving SMS messages, please check with your mobile carrier to ensure that SMS is supported and enabled on your device and plan. You may also need to adjust your device settings or contact your carrier to unblock SMS messages from short codes or specific phone numbers.

10. Privacy and Data Use

By opting in to receive SMS messages, you agree that HerbanVault may collect, use, store, and share your mobile phone number and related information in accordance with our Privacy Policy.

When you opt in to SMS, we collect:

  • Your mobile phone number
  • Opt-in timestamp and method
  • Message delivery status and engagement data
  • Responses to SMS messages (e.g., STOP, HELP, replies to questions)

How We Use Your Information:

We use your mobile phone number to:

  • Send you transactional, promotional, and marketing SMS messages
  • Communicate with you about your orders, account, and customer service inquiries
  • Personalize content and offers based on your preferences and activity
  • Analyze SMS program performance and improve our services
  • Comply with legal obligations and enforce our terms
We do NOT:

11. User Responsibilities

By participating in HerbanVault's SMS program, you agree to the following responsibilities:

Your Responsibilities:

Device and Service:

  • You are responsible for ensuring that your mobile device is compatible with SMS messaging
  • You are responsible for maintaining an active mobile phone service with a supported carrier
  • You are responsible for ensuring that your device is capable of receiving SMS/MMS messages

Accurate Information:

  • You must provide a valid and active mobile phone number
  • You are responsible for updating your phone number if it changes
  • You must notify us immediately if your phone number is disconnected, reassigned, or no longer in use

Compliance:

  • You agree to comply with these SMS Terms and Conditions and all applicable laws and regulations
  • You will not use SMS messages for illegal purposes or to harass, abuse, or spam HerbanVault or other users
  • You will not attempt to interfere with or disrupt the SMS program or related systems

Third-Party Use:

  • You agree not to share, forward, or distribute SMS messages to third parties without HerbanVault's consent
  • You agree not to use SMS messages for commercial purposes or resale

Failure to comply with these responsibilities may result in termination of your participation in the SMS program and suspension or termination of your account.

12. Disclaimer of Warranties

HERBANVAULT'S SMS PROGRAM IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, HERBANVAULT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, or timeliness of SMS message delivery
  • Warranties that SMS messages will be uninterrupted, error-free, or secure
  • Warranties that SMS messages will be delivered to your device or received by you

HerbanVault does NOT warrant or guarantee that:

  • SMS messages will be delivered on time or at all
  • SMS message content will be accurate, complete, or error-free
  • The SMS program will be available at all times or free from technical issues
  • SMS messages will not be intercepted, delayed, or blocked by carriers or third parties

You acknowledge and agree that SMS message delivery is subject to:

  • Carrier availability, restrictions, and limitations
  • Network congestion, outages, or technical issues
  • Device compatibility and settings
  • Factors beyond HerbanVault's control

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HERBANVAULT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE SMS PROGRAM OR YOUR RECEIPT OF SMS MESSAGES.

This limitation applies to all types of damages, including but not limited to:

  • Direct, indirect, incidental, consequential, punitive, or exemplary damages
  • Damages arising from delayed, undelivered, or misdirected SMS messages
  • Charges or fees imposed by your mobile carrier
  • Unauthorized access to or interception of SMS messages
  • Loss of data or information
  • Device malfunction or damage
  • Business interruption or loss of profits

HerbanVault is NOT responsible or liable for:

  • Carrier delays, restrictions, or failures to deliver SMS messages
  • Technical issues, network congestion, or service interruptions
  • Charges or fees imposed by your mobile carrier
  • Unauthorized use of your phone number or device
  • Any damages resulting from your participation in the SMS program

IN NO EVENT SHALL HERBANVAULT'S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SMS PROGRAM EXCEED FIFTY DOLLARS ($50).

Some jurisdictions do not allow the limitation or exclusion of certain types of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Modifications to SMS Terms

We reserve the right to modify, update, or discontinue the SMS program or these SMS Terms and Conditions at any time without prior notice.

When we make changes:

  • We will post the updated SMS Terms and Conditions on our website with a new effective date
  • We may notify you of material changes via SMS message or email (where required by law)
  • Your continued participation in the SMS program after the effective date of any changes constitutes your acceptance of the updated terms

If you do not agree with the updated terms, you must opt out of the SMS program by following the instructions in Section 6.

We may also suspend or terminate the SMS program at any time for any reason, including but not limited to:

  • Legal or regulatory requirements
  • Technical or operational issues
  • Changes to our business operations or services
  • Abuse or misuse of the SMS program

By providing your mobile phone number and opting in to receive SMS messages from HerbanVault, you acknowledge that you have read, understood, and agree to these SMS Terms and Conditions.

You expressly consent to receive automated marketing and transactional text messages from HerbanVault at the mobile phone number you provided. You understand that consent is not a condition of purchase and that you can opt out at any time by texting STOP.

TCPA COMPLIANCE NOTICE

This SMS program complies with the Telephone Consumer Protection Act (TCPA) and related federal and state regulations governing automated text messaging.

By opting in, you provide your prior express written consent to receive automated SMS marketing messages from HerbanVault using an automatic telephone dialing system or artificial/prerecorded voice.
